2. Scope
These terms govern sales made through the website to consumers and, where applicable, to business customers. Consumers always retain the mandatory rights granted by European Union law and by the law of their country of habitual residence.
3. Products and information
The essential characteristics, size, price and availability of products are stated on the relevant product pages. Photographs are for illustrative purposes: minor differences in colour, packaging or presentation do not constitute a defect where they do not change the product’s essential characteristics. In the event of non-material differences from online illustrative material, the mandatory information on the label and packaging prevails.
We do not knowingly publish specific analytical or quality claims that are not documented. Statements concerning origin, process, acidity or other technical characteristics must be interpreted with reference to the packaging, batch and available documentation.
4. Prices, taxes and charges
Prices are expressed in the currency shown on the website and, unless otherwise stated, include applicable VAT. Shipping costs and any surcharges are displayed before the order is confirmed. For deliveries outside the European Union, including Norway, customs duties, import VAT and customs-clearance charges may be payable by the recipient and are not included unless explicitly stated at checkout.
5. Ordering procedure and conclusion of the contract
The customer selects the products, reviews the cart, enters the required information and confirms the order by accepting the applicable terms. Any errors can be corrected before submission. The contract is concluded when ITALIA STANDARD sends the order confirmation to the email address provided by the customer.
We reserve the right to cancel an order before shipment in the event of unavailability, a manifest price or description error, reasonable suspicion of fraud, inability to deliver or another legitimate reason. In that case, any amount already collected will be refunded without undue delay.
6. Payments
Available methods are shown at checkout. Payment is processed by Shopify and/or authorised payment providers. ITALIA STANDARD does not normally store full card details. Charging, authorisation or settlement follows the rules of the chosen method.
7. Availability
Availability shown online may change. If a product becomes unavailable after the order has been placed, we will inform the customer and offer, at the customer’s choice and where possible, a wait, an equivalent replacement or a refund for the unavailable part.
8. Shipping and delivery
Times, areas, rates and thresholds are described on the “Shipping and delivery” page. Dates are estimates and not guarantees, unless expressly agreed. Unless a different deadline has been agreed, delivery will take place within the maximum period required by applicable law.
The risk of loss or damage passes to the consumer when the product is physically received by the customer or by a third party designated by the customer, other than the carrier.
9. Customer information
The customer must provide complete and correct information and verify the address, name, contact details and accessibility of the delivery location. Additional costs caused by incorrect information, failure to collect or unjustified refusal may be charged within the limits of the law and upon documentation.
10. Right of withdrawal
The consumer normally has 14 days from delivery to notify withdrawal, without giving a reason, subject to the exceptions provided by law. The procedure, costs, conditions and exceptions are set out on the “Returns, withdrawal and refunds” page, which forms an integral part of these terms.
11. Defective, damaged or non-conforming products
The consumer benefits from the statutory guarantee of conformity provided by applicable law, generally for at least two years from delivery, taking into account the nature of the goods and their normal lifespan. In the event of an incorrect, damaged, defective or non-conforming product, contact support promptly and provide the order number, a description and, where useful, photographs.
Remedies provided by law may include replacement, restoration of conformity where relevant, a price reduction or termination of the contract. Necessary costs for handling an accepted lack of conformity remain the seller’s responsibility.
12. Food safety and storage
The customer must comply with the storage, use and shelf-life instructions on the packaging. We cannot be held responsible for deterioration caused by improper storage, exposure to heat or light, contamination after opening or use contrary to instructions, without prejudice to the consumer’s mandatory rights.
13. Limitation of liability
Nothing limits or excludes liability that cannot legally be limited, including liability for wilful misconduct, gross negligence, personal injury or consumers’ mandatory rights. In non-consumer relationships, liability is limited, to the extent permitted, to direct and foreseeable losses connected with the relevant order.
14. Events beyond reasonable control
We are not liable for delays caused by external events that cannot reasonably be controlled, such as major transport disruptions, general strikes, disasters, government measures or customs blockages. We will inform the customer and take reasonable steps to reduce the inconvenience.
15. Intellectual property
Trademarks, texts, images, graphics, packaging and website content belong to ITALIA STANDARD or their respective owners and may not be used without permission, except as allowed by law.
16. Privacy
The processing of personal data is described in the “Privacy Policy”.
17. Complaints and dispute resolution
For any complaint, the customer must first contact us at italiastandardtech@gmail.com, stating the order number and providing a complete description. We will seek a direct solution.
Where the applicable requirements are met, a consumer may contact the Mæglingsteamet for Forbrugerklager at Nævnenes Hus and, if mediation does not resolve the dispute, the Forbrugerklagenævnet, in accordance with the rules, jurisdiction and thresholds in force. The former European ODR platform is no longer operational.
18. Governing law and jurisdiction
These terms are governed by Danish law. This choice does not deprive consumers of the mandatory protections guaranteed by the law of the country in which they habitually reside. Disputes may be brought before the competent courts in accordance with applicable European and national rules.
19. Severability and changes
The invalidity of one clause does not affect the remaining provisions. Changes apply to orders placed after publication, unless they are required to comply immediately with legal obligations.
